unChain St Kilda is preparing its legal defence to the developer's application for costs at VCAT, to be awarded against unChain St Kilda.
This time the legal fight is not just about the Triangle; it is about the democratic rights of all Victorians to participate vigorously in planning decisions and to uphold VCAT as a no costs forum.

We need funds to help us challenge and beat our well-financed opponents. To this end, we are organising some major fundraising events and need many hands to make each a success. We're planning fine dining opportunities with our best-loved chefs, musical evenings with some of the many Aussie musicians who have deep connections to the Palais and the local music scene, cinema evenings and other public and small events.

Keep writing to State Government MPs
State Government said it would allow Council the right to see out the process. Well, now Council has made a decision and the State Government needs to have a good look at it. This process and its outcome were implemented in the name of the State Government, the owner of the Crown land site and the heritage public asset, the Palais Theatre.
Ask your MP, your Planning Minister and your Premier:
- Do they support the way community views were marginalised in the Triangle planning decision and how the input of the initial consultation was ignored?
- Why our democratic rights (loss of the right to appeal Council's decision to VCAT) have gone to support developers commercialising crown land?
- Who is watching the process, when third party rights don't exist?
- Ask Martin Foley and John Brumby why the State finds money to support the Grand Prix, but has had none for the Palais Theatre, a public asset.
Tell them
- This decision sets a terrible precedent for public land and the care of the State's heritage.
- This madness must be stopped now and that it is up to the State Government to secure a new plan for the site.
- Tell Martin Foley, MP for Albert Park, to pull his finger out and stand up for his electorate. We are watching and will remember at state election time in 2010.
Many questions about the Triangle development remain unanswered. Ask your elected Councillors to provide the answers.
